Terms of Use for the IMS Application

A. General

1. This document sets forth the terms of use and the privacy policy (hereinafter: "Terms of Use") of the Israel Meteorological Service (hereinafter: "IMS") with respect to the use of this application for weather forecasts and warnings, which is the property of the IMS (hereinafter: "Application").

2. Access to the Application and any use thereof , whether of its content or of the services it provides, whether through a smartphone and/or any other compatible device, and whether or not a registration to the Application has been completed (all of which shall hereinafter be referred to as: "Use", and the person making such Use , "User") , shall be made in accordance with and subject to the Terms of Use, the privacy policy, and any additional instructions and conditions that may be presented in the course of Use of the Application, all of which together constitute the Terms of Use, and each such document in effect forms an integral part of the Terms of Use. By using the Application, the User accepts all the Terms of Use and the privacy policy set forth herein.

3. Without derogating from the uses described above, and to the extent the settings of the device on which the User makes Use so permit, the IMS may store and/or transmit non-personal statistical information that is not identified with the User, for its own purposes and/or to third parties, in order to, among other things, optimize and/or improve the services and/or related services. It is hereby clarified that additional information may be retained in accordance with the privacy policy and/or data storage practices of the end-user device employed by the User, and the IMS has no control over such information.

4. Without derogating from the foregoing, the IMS may transfer to government ministries and/or other state institutions information provided by the User and/or collected about the User by the IMS during registration and/or Use of the Application, insofar as such information is required for the purpose of implementing any legislation and/or for a purpose within the scope of the authorities or functions of the IMS or of the recipient of the information.

5. Please read the Terms of Use and the privacy policy carefully. The Use of the Application or any part thereof, and any action taken through it, constitutes the User's consent to accept all the Terms of Use and to act in accordance therewith, and the User shall have no claim, demand, or cause of action against the IMS and/or anyone acting on its behalf. If the User does not agree to any of the Terms of Use and/or the privacy policy, the User is requested to immediately cease all Use of the Application and to delete the Application from the device on which the User makes Use.

6. The Application is provided for Use on an "as is" basis, and the IMS reserves the right to make changes at any time to the Terms of Use and/or the Application, including but not limited to changes to its structure and/or design and/or to discontinue and/or modify and/or impose conditions on the services, in whole or in part, and/or to change the dates on which the services are provided and/or the times at which the Application may be used, and it is hereby agreed that the User shall have no claim, cause of action, and/or demand against the IMS and/or anyone acting on its behalf in connection with such changes and/or malfunctions occurring in the course of implementing them.

It is further clarified that the foregoing in this section shall also include blocking access to the Application of any User for any reason whatsoever, including for carrying out an action in violation of the provisions of law and/or the Terms of Use, without any obligation or requirement to provide reasons and/or prior notice to the User or to anyone acting on the User's behalf, and at the sole discretion of the IMS.

Any such change and/or addition shall take effect and apply to all Users immediately upon implementation and publication. Any action taken in the Application after such publication shall be subject to the updated version as amended.

7. It is clarified that the IMS may condition certain services on acceptance of separate and distinct terms of use, and the enrollment in and/or Use of such additional services shall be subject to additional instructions and/or rules that will appear in the Application alongside the relevant service; provided, however, that they shall not derogate from the provisions of these Terms of Use.

8. Use of the Application requires a mobile device running Android 8.0 or later, or iOS 16 or later, and a stable internet connection. It is clarified that the IMS does not undertake to support every device meeting the minimum requirements set forth above, and that there may be devices excluded from use of the Application due to technical limitations and/or other considerations of the IMS. The IMS may also, from time to time, update the minimum requirements for Use of the Application in accordance with its needs. For proper Use of the Application, the User is required to verify that the User is using the latest version available for the User's device.

9. As a condition of Use of the Application, the User undertakes not to use the Application for any unlawful and/or offensive purpose and/or for any purpose that would disrupt, interfere with, alter, impair, restrict, or affect in any way the operation of the Application and/or its servers, including by means of a virus, worm, Trojan horse, malware, spyware, or any other means. Without derogating from the foregoing and without derogating from any other remedy or relief, the IMS shall be entitled to deny access to any User who, at the sole discretion of the IMS, carries out or attempts to carry out any action in the Application that is contrary to these Terms of Use and/or any applicable law and/or that may in any way harm the Application and/or the authority and/or any third party.

10. All data provided by the User in the course of Use of the Application, including personal identification details and additional information, is provided of the User's own free will, and no legal obligation to provide such data applies. Furthermore, changes involving the modification and/or addition of data, including data collected about the User, as well as any new uses of such data and the like, shall be made subject to the privacy policy set forth herein.

11. The Terms of Use are drafted in the masculine gender for convenience only, but are intended for both women and men alike. Where the Terms of Use are drafted in the singular, the reference shall also include the plural, and vice versa.

12. Any breach of any of the Terms of Use constitutes a fundamental breach, entitling the Israel Meteorological Service and/or anyone acting on its behalf to revoke the right of Use of and access to the Application and even to institute legal proceedings in accordance with the rights of the IMS and/or third parties under any applicable law.

13. This document shall be governed by the laws of the State of Israel, and the exclusive jurisdiction shall lie with the competent court in the city of Rishon LeZion.

B. Ownership and Rights

14. The Application (including, without limitation, the domain name, the organization and arrangement of information in the Application, the images in the Application, trade secrets, the graphic design of the Application, the text of the Application, the databases therein, the source code, and any other detail relating to the operation and design of the Application), as well as the content displayed therein, are the exclusive property of the IMS, protected by intellectual property rights, including copyright, or of a third party that has granted its authorization for use and publication by the IMS.

Any use of the Application and of the content therein (in whole or in part) shall be subject to the law and to all the conditions set forth herein , protected under copyright law and exclusively owned by the IMS and/or the State of Israel and/or licensors (whether service users or third parties) who have granted the IMS a license or right of use therein.

15. It is prohibited to operate and/or to allow any third party to operate any application or other means that enables the full or partial copying of content from the Application, and, without limiting the generality of the foregoing, it is prohibited to create and/or use such means for the purpose of creating a collection, compilation, or database containing content from the Application.

16. It is prohibited to copy, transfer, distribute, edit, reproduce, sell, publicly display, modify, broadcast, share, download, or develop any of the content displayed in the Application, and/or to grant a license and/or to transfer access to the Application and/or to perform any action that may harm the Application and/or the privacy of other Users of the Application.

It is nevertheless clarified that, with respect to the content in the Application, derivative works may be made subject to all the provisions herein and subject to the provisions of law, including under the fair use defense.

17. To the extent that Use is made of the Application, including its content, as well as fair use as described above, such use shall be made with a prominent and clearly visible attribution stating that the source of the information is the IMS, in a manner that is not misleading and/or that does not create a false representation and/or that may not damage the IMS, including its reputation and/or name, and further stating that the IMS bears no responsibility whatsoever for the information, including the use of the information, and that the IMS is not a party to its publication. This obligation to give credit to the IMS shall not apply where the information has been processed in such a manner that it cannot be reconstructed without considerable technical effort (Non-Retrievable Value Added Services).

18. Without derogating from the foregoing, and for the avoidance of doubt, it is clarified that the Terms of Use grant the User the right to use the Application and its services only, and the User is prohibited from performing any action that may infringe upon the intellectual property rights set forth above.

C. Liability

19. The User shall bear sole responsibility for any Use made and, by using the Application, releases the IMS and/or anyone acting on its behalf from all liability and/or claims and/or complaints. Without limiting the generality of the foregoing, it is the User's responsibility to verify the content of the Application, including its accuracy, completeness, currency, validity, and suitability for the User's use. Should the User discover anything in the Application that appears erroneous and/or corrupted and/or inaccurate and/or not current, the User is invited to share such findings with the IMS.

20. The IMS and/or the Government of Israel and/or anyone acting on their behalf shall not be liable for the completeness, accuracy, currency, availability, or quality of the content in the Application, nor for any errors or inaccuracies therein.

21. The IMS and/or the Government of Israel and/or anyone acting on their behalf shall not be liable for any Use made of the Application.

22. The IMS and/or the Government of Israel and/or anyone acting on their behalf shall bear no liability and shall not bear any payment for any damage, loss, expense (including loss of income or profit), and/or any other consequence, whether direct or indirect, caused to the User and/or to any third party by any act or omission arising from Use of the Application.

23. The Use shall be made at the sole discretion and sole responsibility of the User, and the User shall bear all damage, loss, expense (including loss of income or profit), and/or any other consequence, whether direct or indirect, caused to the User and/or to any third party by any act or omission arising from or as a result of the Use. The User shall be precluded from raising any claim against the IMS and/or the Government of Israel and/or anyone acting on their behalf, and/or from making any demand and/or bringing any claim in respect of any damage, payment, charge, or demand caused to the User or to any person as a result of the Use, as aforesaid.

24. The IMS does not guarantee the continuity of service of the Application, including the provision of all or part of its content, and/or the duration of provision of any content in the Application. The IMS reserves the right to modify the scope and/or substance of the content in the Application and/or the manner of delivery/publication and accessibility of the content, all without prior notice, and the User shall have no claim and/or demand and/or cause of action in connection therewith. The IMS shall not bear any liability arising from or in connection with the availability of the services and/or reliance thereon.

25. The User is solely responsible for the technical equipment (device) in the User's possession and for the internet connection, and the IMS shall not be liable for any damage that may be caused to the technical equipment and/or communications of the User and/or of any third party, including viruses and/or any unauthorized access to the IMS servers and/or any other interference. Furthermore, the IMS is not liable for any difficulty and/or technical impediment that may impair the ability to use the Application, and the User shall have no claim and/or cause of action in connection with such difficulty and/or impediment. Without derogating from the foregoing, the IMS shall make every reasonable effort to rectify any malfunction and/or impediment and/or problem and/or technical error in the Application, to the best of its ability and with the means available to it at the time.

26. In light of the foregoing section, and given that, as clarified above, the IMS has no obligation whatsoever as to the continuity or completeness of the information, it is the User's responsibility to arrange, at the User's own expense, a backup mechanism for situations in which information originating from the Application is not received and/or is not received at the expected time. In cases where the flow of information from the Application is disrupted, the User is invited to notify the IMS.

27. Official Publications of the State of Israel. In the event of any contradiction and/or discrepancy between information published in the Application and/or provided by the IMS, and material appearing in the official written publications of the State of Israel, the material in the official publications shall be deemed to be correct for all intents and purposes.

D. Privacy, Information Security, and Confidentiality

28. The Application does not require and does not collect personal information about the User, such as name, telephone number, email address, residential address, date of birth, or any other means of personal identification. The Application does not require the creation of an account or login. All information collected about the User or about the User's Use is of a technical nature and pertains solely to the device through which the Application is operated by the User.

29. It is clarified, however, that for the purpose of providing optimal service in the Application, technical information is collected, including details of the device through which the Application is operated by the User (such as device type, model, and operating system), Application settings (such as language and display mode), and alert preferences (such as monitored cities and areas, and types of weather warnings). The Application saves the selected preferences in order to send the User relevant weather warnings based on the selected cities and areas.

30. To the extent that the User has enabled location-based alerts, the Application will use GPS in accordance with the permission granted by the User. The Application relies on the smartphone's location, obtained through the device's GPS system. This location data is not stored on the system's servers. The use of the GPS system is made solely for the purpose of the Application's operation. Access to location data shall occur only upon entry into and use of the Application. To this end, the smartphone must be connected to the internet and the "location services" feature must be enabled. Approval of the use of location data will enable the display of personalized weather forecasts and warnings. The User may also select preferred localities for receiving regular warnings, as described above.

For the avoidance of doubt, the User consents to the Application's use of the geographic location, preferences of relevant localities, and all data entered by the User in the Application. It is clarified that no information regarding the manner of use of the User's personal device shall be retained.

31. It is further clarified that the Application uses Google and Apple notification services for the purpose of sending alerts and updates to the device.

32. In addition, the Application uses an error monitoring service for the purpose of identifying and rectifying technical malfunctions. This service may collect technical information about the device and about the use of the Application when errors occur.

33. For the avoidance of doubt, it is clarified that the IMS does not sell, trade in, or share the collected information with third parties for marketing purposes. The information collected is shared only with the service providers mentioned above, solely for the purpose of operating the Application.

34. The Application is suitable for use from age 6 and above. It is clarified that, as stated and detailed above, the Application does not collect personal information as defined under the Protection of Privacy Law, 5741–1981, except for the option of location data during entry into and use of the Application, for which the User's permission must be granted, if the User so wishes. Accordingly, the use of the Application by users under the age of 13 is conditional upon obtaining verified parental consent in advance.

35. The IMS takes reasonable measures to protect the technical information collected by the Application from unauthorized access, alteration, or loss.

36. As stated, the User details that are retained are limited to those essential for improving the service and for the proper operation of the Application, and for the purpose of providing optimal service to the User. The IMS takes appropriate and accepted measures in the field to safeguard such User details using advanced information security and protection tools, including in accordance with the law, and in particular the Protection of Privacy Law, 5741–1981. Nevertheless, no absolute guarantee can be given that the Application is immune from errors, malfunctions, or unauthorized intrusions and misuse of information.

37. This policy may be updated from time to time, and Application users will be notified by means of a notice in the Application. The last update date is 12.04.2026. It is clarified that continued use of the Application following any changes constitutes consent to the updated policy.

User details, including personal information provided to the IMS, insofar as such information is required for the purpose of receiving any service, shall be kept confidential in accordance with the provisions of the Protection of Privacy Law, 5741–1981.

38. Under the Protection of Privacy Law, 5741–1981, you or anyone acting on your behalf have the right to review information collected (insofar as any is collected) about you in the course of Use of the Application and held in the IMS databases, and further to request that the IMS correct such information if it is inaccurate, incomplete, or imprecise.
