Rights and Terms of Use of the IMS Application

The information contained in the Israel Meteorological Service's online application (hereinafter: "the Application" and "IMS," respectively) and any information provided by the IMS, unless expressly stated otherwise in writing by the IMS (hereinafter: "the Information"), is the exclusive property of the IMS, protected by intellectual property rights, including copyright. Any use of the Information shall be subject to the law and to all the terms set forth below.

The Information may be copied, distributed, made available to the public, broadcast, and used in derivative works subject to the provisions below, and subject to the provisions of the law, including the fair use doctrine (hereinafter: "Use of the Information" / "Use"). Reliance of any kind on the Information shall also be deemed Use.

Any Use of the Information must include clear and prominent attribution that the source of the Information is the IMS, in a manner that is not misleading and does not create a false impression and/or harm the IMS, its reputation, or its name. It must also be stated that the IMS bears no responsibility whatsoever for the Information, including its Use, and that the IMS is not a party to its publication. This requirement of attribution shall not apply in cases where the Information has been processed in such a way that it cannot be technically retrieved without significant effort (Non-retrievable Value Added Services).

The user of the Information shall bear sole responsibility for any Use of the Information, and by using the Information, waives any liability and/or claim and/or complaint against the IMS. Without derogating from the generality of the foregoing, the user shall be responsible for verifying the accuracy, completeness, timeliness, validity, and suitability of the Information for their use. Should the user find anything suspected of being incorrect, corrupted, inaccurate, or outdated, they are encouraged to share their findings with the IMS.

The IMS and/or the Government of Israel and/or their representatives are not responsible for the completeness, accuracy, timeliness, availability, or quality of the Information, nor for any errors or inaccuracies contained therein. The IMS and/or the Government of Israel and/or their representatives are not responsible for any Use of the Information. They shall not bear liability or be required to make any payment for any damage, loss, expense (including loss of income or profit), or any other consequence, direct or indirect, incurred by the user of the Information and/or any third party, due to any act or omission arising from Use of the Information.

The IMS makes no commitment to continuous provision of the Information, in whole or in part, or regarding the duration of its provision. The IMS reserves the right to modify the scope, content, method of transfer/publication, or accessibility of the Information, without prior notice, and without the user having any claim or demand in this regard.

In light of the above, and as explicitly stated, since the IMS has no commitment to the continuity or completeness of the Information, it is the sole responsibility of any user intending to develop a continuous service based on the Information to implement, at their own expense, a monitoring mechanism of the incoming data and to detect interruptions in data flow. The developer must also provide, at their own expense, a backup mechanism for cases where the Information is not received or not received in due time. In cases of data disruption, the user is encouraged to notify the IMS.

Any breach of these terms of use constitutes a fundamental breach, entitling the IMS and/or its representatives to immediately cease supplying the Information, in addition to any other rights available to the IMS under any law, without derogating from the foregoing.

Confidentiality: Any personal information provided to the IMS, insofar as it is required for the provision of a service, will be kept confidential in accordance with the provisions of the Privacy Protection Law, 1981.

Official publications of the State of Israel: In the event of a conflict or discrepancy between the Information published in the Application and/or provided by the IMS and the material appearing in the official written publications of the State of Israel, the official publications shall prevail for all intents and purposes.
